House Rules

Cancellation Policy
- Travelers who cancel at least 30 days before check-in will get back 100% of the amount they've paid. If they cancel between 15 and 30 days before check-in, they'll get back 50%. Otherwise, they won't get a refund.

Damage and incidentals
- $250 Security Deposit will be placed against your credit card 3 days before check-in.
- You will be responsible for any damage to the rental property caused by you or your party during your stay.
- If there is damage to the rental property during your stay, you may be charged.

SHORT-TERM RENTAL AGREEMENT

Landlord and Tenant(s) ("Parties") agree to the following terms and conditions:

I. Family Rental Only
Reservations made for teenagers or young single groups will not be honored without any accompanying adult staying in the unit at ALL times. We require at least one member of the party to be 25 (twenty-five) years of age. Any violators will be evicted according to Florida Statute 508.141 with forfeiture of all monies.

II. Falsified Reservation
Any reservation obtained under false pretense will be subject to forfeiture of reservation deposit, damage deposit, and/or balance of rental payment.

III. Parking
The Landlord shall provide parking as part of this Agreement. There shall be no fee for the parking space(s). Parking is first come first serve.

IV. Period and Guests
The total amount of individuals allowed to stay at the Property for any period will be limited to 8 people. In addition, the Tenant(s) are allowed to have a total number of 8 Guests on the Property.

V. Check-in & Check-out
The Tenant(s) shall be allowed to check-in at 04:00 PM (Eastern Time) and check-out at 11:00 AM (Eastern Time). Earlier check-in and check-out must be approved by Landlord before arrival.

VI. Pets
Under no circumstance shall the Tenant(s) be allowed to have any type of pet on the Property unless a licensed physician has authorized its use due to a psychiatric or physical disability.

VII. Events
Under no circumstance shall the Tenant(s) be allowed to have any type of event or public gathering on the Property.

VIII. Pool
Tenant(s) shall not permit any use of pool by unsupervised children or other guests and shall keep gates closed. Tenant(s) and other invitees shall use the pool at their own risk. Tenant(s) understands that there are certain inherent risks to person and property located adjacent to the ocean, including the possibility of drowning. Tenant(s) acknowledges that the owner would not rent the property unless the Guest accepted this condition. There are not lifeguards on site at any property. Tenant(s) are responsible for their safety and the safety of their children and guests. Pools are for registered guest use only. Please swim safely and at your own risk. Please keep noise level down and be courteous of others. Please observe pool and spa rules as directed by signage at the pool area. Guests are not allowed to touch pool equipment and settings.

IX. Dock
Tenant(s) shall not permit any use of dock by unsupervised children or other guests and shall keep gates closed. Tenant(s) and other invitees shall use the dock at their own risk. Tenant(s) understands that there are certain inherent risks to person and property located adjacent to the ocean, including the possibility of drowning. Tenant(s) acknowledges that the owner would not rent the property unless the Tenant(s) accepted this condition.

X. CATASTROPHIC EVENTS, MANDATORY EVACUATIONS, MECHANICAL FAILURES
If a catastrophe (hurricane, tornado, earthquake, flood, etc.) or any situation simply beyond our control impairs the vacation rental, Landlord is not responsible for finding alternate lodging for the renter or for the renter's financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY OR MANDATORY EVACUATIONS issued by Local, State or National law authorities. If Local, State or National authorities order a mandatory evacuation of an area that includes the Property, Tenant shall comply with the order. Tenant agrees to vacate and secure property within 4 hours of the start of the mandatory evacuation order. Therefore, we suggest you consider Trip Cancellation & Travel Insurance Program to secure your vacation investment and eliminate your financial risk. We will not provide refunds or credits for unforeseen mechanical failures such as appliances, plumbing, or other unforeseen problems.

XI. Termination
Landlord has the right to inspect the premises with prior notice in accordance with applicable State laws. Should the Tenant(s) violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with State law. Tenant(s) waive all rights to process if they fail to vacate the premises upon termination of the rental period. Tenant(s) shall vacate the premises at the expiration time and date of this agreement.

XII. Utilities
No compensation will be given for temporary outage of electricity, gas, water, cable, or telephone service. Outages will be reported immediately, and all efforts will be made to have them restored as soon as possible.

XIII. Maintenance and Repairs
The Tenant(s) shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. Tenant(s) shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants.

XIV. Trash
Landlord requires the Tenant(s) to use the following instructions for trash removal on the Property: Make sure that the garbage/trash is removed before you leave. The trash chute is located in a room of the stairwell at the north end of the building. There are also bins for recycling in the parking lot to the right of where you enter the parking lot.

XV. Subletting
Tenant(s) shall not be allowed to sublet the Property. If Landlord does allow the Tenant(s) the right to sublet, an amendment must be signed by both Landlord and Tenant(s) and shall be attached to this Agreement.

XVI. Quiet Enjoyment
The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Any and all noise must be kept to a minimum each night beginning at 10:00 PM (Eastern Time)

XVII. Smoking, Vaping or E-Cigs
Any and all forms of smoking and or vaping shall not be permitted inside the Property, nor on the Balconies or Terrace. All smoking and or vaping activities MUST occur outside of the entire unit. Charges will apply for smoking and or vaping inside the unit, Balconies or Terrace.

XVIII. Landlord’s Liability
The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenant(s) expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenant(s), and that Tenant(s) should purchase their own insurance for Tenant(s) and Guest(s) if such coverage is desired.

XIX. Attorney’s Fees
Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.

XX. Use of Property
Tenant(s) expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenant(s) do not intend to make the property a residence or household.

XXI. Shortened Stays and Conditions
There shall be no refunds due to unexpected weather conditions or unexpected building maintenance.

XXII. Showings
If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the stay of the Tenant(s). Every effort will be made to schedule the showing at a convenient time and not interrupt the day-to-day activities of the Tenant(s). Tenant(s) shall allow reasonable viewings of the Property during standard hours.

XXIII. Firearms
Only legally owned and permitted firearms shall be allowed on the premises in accordance with State and local laws.

XXIV. Fireworks
The Parties agree that Fireworks and other hazardous materials may not be used in or around the Property.

XXV. Illegal Use
Tenant(s) shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this Agreement with no refund of rents or deposits.

XXVI. Fire Alarms
If the Property has fire alarms the Tenant(s) must notify the Landlord without delay if a fire alarm “chirps” or has a low battery condition.

XXVII. Entry By Owner
Owner or owner's agents may enter the premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the premises to prospective purchasers, tenant(s) or contractors. Owner will provide tenant(s) with at least 24 hours’ notice of Owners intent to enter (except in the case of an emergency).

XXVIII. Keys
There shall be no keys given to the Tenant(s) at the time of possession. If Tenant(s) is given any keys and should lose any of the keys, a penalty fee will be due. Codes will be given to Tenant(s) for access to the unit, terrace, elevator, and community bathroom.

XXIX. Possessions
Valuable items left behind by Tenant(s) will be held with every reasonable effort made to contact in order for a safe return. If items are not claimed for longer than 6 months they shall become the property of the Landlord. Landlord shall not be held liable for the condition of said items left by the Tenant(s).

XXX. Governing Law
This agreement is governed under the laws of the State of Florida.

XXXI. Lead-Based Disclosure
It is acknowledged by the Parties that the Property was not constructed prior to 1978. Therefore, the Lead-Based Paint Disclosure Form is not required per federal law.

XXXII. Cancellation
100% refund if you cancel at least 30 days before check-in. 50% refund (minus service fee) if you cancel at least 14 days before check-in. No refund if you cancel less than 14 days before check-in.

XXXIII. Severability
In the event any provision or part of this Agreement is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Agreement, will be inoperative.
